Daniel Duggan, a former US fighter pilot, is facing extradition from Australia after a lengthy legal battle concerning accusations that he trained Chinese soldiers in South Africa from 2010 to 2012, allegedly violating US arms-trafficking laws. Duggan has been imprisoned for over three years while combating these allegations, which originated from a request by the US authorities.

He was apprehended in 2022 while shopping in regional New South Wales, where he resides with his wife, Saffrine, and their six children. His family’s struggle against the extradition mounted significant stress, especially after the Australian attorney-general, Mark Dreyfus, endorsed the extradition in December 2024.

Despite a subsequent appeal to the Federal Court in Canberra, presided over by Justice James Stellios, his claims were dismissed and he was ordered to cover the government’s legal costs. Duggan’s defence argued that the charges brought against him were not offences under Australian law at the time of the alleged activities, thus contravening the requirements of the extradition treaty between the two nations.

Should Duggan wish to contest this decision further, he can file an appeal within 28 days. The condition for a lawful extradition stipulates that an offence must be considered criminal in both the requesting and the requested countries—a point Duggan’s lawyers aimed to highlight.

Throughout this ordeal, Duggan’s family has endured severe financial strain, with legal expenses mounting to approximately half a million dollars. The situation has been exacerbated by the denial of Legal Aid and restrictions on their unfinished home, prohibiting them from selling or living in it. Duggan has been held in a maximum-security facility approximately 100 kilometres from his family, adding to the distress of his loved ones.

The case against him was initiated during Donald Trump’s presidency, with charges being filed in a sealed court proceeding. Duggan has expressed his belief that his actions were legal and that both Australian and US intelligence agencies were aware of his activities.

The outcome of this case presents significant implications not only for Duggan and his family but also for Australian-American relations and legal standards around extradition processes. As developments continue to unfold, all eyes will be on the potential next steps in the appeals process regarding Duggan’s extradition to the United States.
