The indictment claims that a reasonable observer would interpret Comey’s post as a serious expression of intent to harm the President. Under scrutiny, the number “86” is identified in Merriam-Webster’s dictionary as slang for “to throw out” or “to kill,” an interpretation the Department of Justice has endorsed in the context of this case.
While Comey has stated that he intended no harmful implication and has argued against the interpretation of his post, the allegations against him stand firm. He has been charged with making a threat against the President and transmitting a threat across state lines, facing a possible maximum sentence of ten years if convicted.
Acting Attorney General Todd Blanche commented on the gravity of the accusation, noting that threats against a sitting President are serious violations of law. The indictment follows a wider climate of tension and threats directed at political figures, including a recent shooting incident near the White House targeting Trump.
Current FBI director Kash Patel, a Trump ally, condemned Comey’s actions, asserting that, as a former FBI director, he should have understood the implications of his post. Despite removing the post soon after, Comey clarified that he was unaware of any violent connotations associated with those numbers and reiterated his opposition to violence.
