In Toorak, Melbourne, Nicholas Jackson has been battling to have a tree in his front yard removed, a decision he may ultimately need to escalate to the Supreme Court. Having lived in his home for three decades, Jackson claims that maintaining the tree has led to substantial costs due to frequent plumbing issues in his property. "I’ve noticed more plumbers digging up my garden for repairs related to water and drainage," he explained to A Current Affair.
His requests to the Stonnington Council for tree removal have been denied twice, with authorities asserting that the tree is in good health and enhances the suburb’s livability. A council spokesperson highlighted that they found no credible evidence connecting the tree to the reported damage, and offered the homeowner alternative low-cost solutions without the need for removal.
Despite his claims of tens of thousands spent on plumbing repairs, Jackson estimates further costs could approach $100,000 due to the tree’s influence on his driveway’s paving. Frustrated, he advocates for a practical approach: "Let’s just replace the darn thing before it becomes an even bigger problem."
Jackson has been advised he can escalate the issue to the Victorian Ombudsman or take it to court, although he hopes for an amicable resolution prior to such measures. He noted, "In this wide, crazy world, I don’t think this tree deserves to go to the Supreme Court."
The Stonnington Council stressed its commitment to preserving urban trees, essential for community well-being and environmental resilience. Their policies on tree removal applications are thoroughly structured, considering each case based on independent assessments, which in Jackson’s situation, have not corroborated the extent of damage claimed. They pointed out that the resident has options for review, including a complaint to the Victorian Ombudsman, which appears to remain unexploited by Jackson.
Overall, the council aims to balance individual grievances with the collective interests of the community, affirming the importance of maintaining healthy, mature trees for the future sustainability of local environments.
