An Australian shopper has sparked a debate over receipt laws after a frustrating encounter at a Coles supermarket in Victoria. The shopper, who was browsing with a trolley filled with groceries purchased from Aldi, was asked by a self-checkout attendant to show a receipt for a 30-pack of Coke cans to prove it hadn’t been stolen. Perplexed, the shopper explained that they did not keep receipts unless for significant purchases.

Seeking clarity, the shopper turned to Reddit’s AusLegal page, prompting widespread discussion. Several users questioned the legality of the policy demanding proof of purchase for items bought at other retailers. Jahan Kalantar, a criminal defence lawyer, weighed in on the issue, clarifying that retailers like Coles and Woolworths lack the legal authority to mandate shoppers to produce receipts for goods obtained elsewhere.

Kalantar noted that while security staff can ask to inspect bags if theft is suspected, their power is limited; they’re unable to forcibly detain individuals. He cautioned that if a store employee wrongfully retains a shopper against their will, it could result in a false imprisonment claim.

Most customers typically show their receipts to diffuse such situations, but Kalantar emphasised that, legally, shoppers should not feel obligated to share this information if they’ve committed no wrongdoing. The law does support personal privacy rights, and unless there’s clear evidence of theft, such as security footage, shoppers cannot be compelled to provide proof of purchase from different stores.

In light of this incident, 9News.com.au reached out to Coles for their perspective on the matter. This situation has raised questions about customer rights and retailer policies, highlighting a need for clearer communication and understanding of legal boundaries in everyday shopping scenarios.
