Nicky Winmar Seeks to Co-Lead AFL Racism Class Action Lawsuit

AFL legend Nicky Winmar has expressed a desire to courageously co-lead a significant class action lawsuit against racism, initiated by former Indigenous players. This landmark case, filed in September 2023 in the Supreme Court by Phil Krakouer, who played 141 matches for North Melbourne, claims that senior AFL officials failed to take action against racism in the sport.

The lawsuit alleges that from 1975 to 2022, numerous players experienced instances of racism, including vilification, discrimination, and abuse while involved in the AFL. Krakouer, who has been leading the case, may soon be joined by Winmar as a co-plaintiff, highlighting the importance of this issue, given Winmar’s historical context within the league.

The AFL is contesting the claims, with barrister Mark Costello KC questioning the appropriateness of having Winmar involved in the suit, particularly as he is also involved in a separate case related to concussion. Costello expressed concern over delays associated with this case, which had been initiated 18 months prior.

Winmar’s involvement is significant; he has long been an advocate against racial injustice within the game. During a notorious 1993 match against Collingwood, he famously confronted racist abuse by lifting his jersey and emphatically declaring his pride in his Indigenous heritage, asserting, “I’m black and I’m proud to be black.” This act of defiance has since been immortalised with a statue outside Perth Stadium.

Michel Margalit, representing the plaintiffs, confirmed Winmar’s willingness to take on the role of co-lead plaintiff, viewing his participation as a brave step forward in the fight against racial vilification in football. She emphasised Winmar’s legacy as a trailblazer who fights for the safety and dignity of all players in the sport.

The case has been adjourned for further proceedings, as legal teams evaluate the implications of Winmar’s potential leadership role. This highlights a pivotal moment in the AFL, reflecting ongoing struggles against racism and the push for a more inclusive and respectful environment in Australian football.
