The Australian federal government is set to introduce new legislation aimed at eliminating unfair trading practices and hidden fees during online purchases. Consumer advocacy groups have welcomed this initiative, which aims to protect consumers from deceptive pricing tactics, particularly in the face of rising living costs.
Federal Treasurer Jim Chalmers announced that the government is focusing on practices such as ‘subscription traps’—where consumers find it challenging to cancel memberships—as well as ‘drip pricing’, where additional fees become apparent only at checkout. The legislation will also address dynamic pricing, which allows retailers to change prices during the purchasing process, and the requirement for consumers to create an account before making a purchase.
Chalmers emphasised that the changes aim to ensure fairer trading and ultimately save Australians money. Assistant Minister for Productivity and Competition, Andrew Leigh, highlighted how such practices undermine consumer trust and threaten household budgets. The legislation, first signalled back in October 2024, is expected to take effect on July 1, 2027.
Consumer groups have lauded the government’s move, with numerous organisations backing the initiative. Erin Turner, CEO of the Consumer Policy Research Centre, remarked that the absence of bans on unfair business practices has long been a glaring oversight in Australian consumer law. Stephanie Tonkin from the Consumer Action Law Centre noted that as shopping increasingly moves online, it is crucial to implement these protections to ensure consumers are not exploited in the digital marketplace.
The reforms will mandate that subscription services clearly inform customers about automatic renewal payments and provide an easy cancellation process. Additionally, all transaction fees must be disclosed prominently before completing a purchase.
