A drunk driver responsible for a tragic hit-and-run incident that led to a woman’s death has been sentenced to nearly five years in prison. The case involving Maddison Bain, who was intoxicated and driving on a poorly lit road near Mandurah, Western Australia, resulted in the death of 32-year-old Kelly T’Hart, who was described as the emotional anchor of her family.

The incident occurred almost two years ago when T’Hart was struck while walking. At the time, Bain, who had a blood alcohol concentration four times above the legal limit, ignored warnings from passengers in her car to drive more cautiously. After hitting T’Hart, Bain abruptly continued driving, leaving the victim to die on the road.

This heartbreaking event spurred T’Hart’s family to campaign for legislative changes to prevent individuals who cause fatal accidents from being permitted to drive while out on bail. The advocacy led to the introduction of “Kelly’s Law,” which is currently under consideration by the Parliament.

Bain was ultimately sentenced to four years and 11 months in prison and prohibited from driving for an additional three and a half years. During the court proceedings, T’Hart’s mother, Susan, expressed her grief, urging the public against drink driving and highlighting the importance of taking alternative transport options. While Bain showed remorse when confronted with the consequences of her actions, emotional responses were more prominent when her own children’s future was discussed.

The case not only represents a personal tragedy for T’Hart’s family but also serves as a catalyst for potential legislative reform, aiming to enhance road safety and prevent similar tragedies. Family friends have expressed pride in T’Hart’s legacy and the impact of the changes driven by her family’s grief and determination to prevent further loss.
