The definition of “social media” has caused some confusion regarding the recent legislation aimed at restricting access for users under 16, alongside significant penalties for non-compliance. The government has made efforts to clarify which platforms will be affected. Communications Minister Michelle Rowland has confirmed that the new laws will apply at least to TikTok, Facebook, Snapchat, Reddit, Instagram, and X, while indicating that other platforms will also need to enforce the age restriction.
Exemptions are set for certain platforms, including Facebook Messenger Kids, WhatsApp, and various educational and mental health-focused apps like ReachOut’s PeerChat and Kids Helpline MyCircle. Rowland stated that some messaging services and video games will also be exempt. The process for exemptions will involve professional consultation, requiring the communications minister to consider advice from the eSafety Commissioner and other relevant authorities.
