California judge facing murder charges in wife’s death results in mistrial

The murder trial of Jeffrey Ferguson, a judge from Orange County, California, ended in a mistrial on Monday, as the jury could not reach a unanimous decision. Los Angeles Superior Court Judge Eleanor J. Hunter announced the mistrial after eleven jurors favoured a guilty verdict for second-degree murder, while one juror remained unconvinced. Prosecutors expressed their intention to retry the case.

Ferguson, aged 74, stands accused of fatally shooting his wife, Sheryl, during an argument at their home in Anaheim Hills in 2023. The incident occurred while they were watching television after a dispute. Ferguson admitted to discharging the firearm but claimed it was accidental. In his testimony, he stated he was attempting to place his gun on a table after fidgeting with an ankle holster when the shot went off.

The trial, which took place nearby Ferguson’s regular courthouse, included footage of him in distress shortly after the shooting, where he expressed his remorse and concern for his family. Prosecutors highlighted his actions prior to the incident, alleging he had consumed alcohol and made threatening gestures during a prior argument at a restaurant concerning family finances.

Following the mistrial, Orange County District Attorney Todd Spitzer indicated that the prosecution would consult with Sheryl Ferguson’s family before deciding on the next steps. He emphasised the need for justice, while Ferguson’s attorney, Cameron Talley, suggested a possible deal might be reached, noting the support Ferguson has from his family and the absence of intent to kill.

Larry Rosen, Sheryl’s brother, voiced his belief that the shooting was accidental, supporting the notion that it should not be classified as murder. He stated that the jury’s deadlock illustrated the conflict surrounding the incident, which has stirred considerable emotions in the local legal community.

Ferguson’s legal career began in 1983, culminating in his appointment as a judge in 2015. However, he has been barred from presiding over cases while facing felony charges. The Orange County district attorney’s office is also set to review previous cases handled by Ferguson due to his admission of consuming alcohol before returning to his judicial duties.

Overall, Ferguson’s case has captivated public attention, raising questions surrounding domestic disputes, firearm safety, and the judicial system’s integrity. The mistrial leaves room for further legal proceedings, ensuring that the case continues to garner scrutiny.
