Man denies involvement in home invasion that resulted in alleged accomplice’s death.

Desmond Avery has pleaded not guilty in Lismore District Court to charges related to a violent home invasion that resulted in significant injuries to a grandfather and the death of his alleged accomplice. During the hearing, Avery denied multiple allegations, including breaking and entering, aggravated assault with intent to rob, and causing grievous bodily harm to 66-year-old Allan Kerr.

The incident occurred on April 9, 2024, at a residence in Kingscliff, near Tweed Heads in northern New South Wales, where emergency services were dispatched shortly after 8 PM. Upon arrival, they discovered Kerr with serious injuries and his alleged accomplice, 29-year-old Trae Laurie, deceased.

Investigations revealed that Avery and Laurie reportedly forced entry into Kerr’s home armed with an axe and disguised to hide their identities. During the altercation, Kerr defended himself and allegedly fatally stabbed Laurie as he was being attacked with the axe. Following the assault, Kerr was airlifted to Gold Coast University Hospital, where he underwent surgery due to severe injuries, including a partially severed arm.

After the incident, Avery fled the scene in a silver Toyota Corolla but was apprehended the next day at a different Kingscliff location. Police confirmed that Kerr did not have prior knowledge of either Avery or Laurie.

During court proceedings, Judge Craig Everson inquired if Avery was related to notable surfer Tom Avery from the NSW south coast. Due to procedural issues arising from a burst water main impacting the Sydney Downing Centre court complex and the need for key witness availability, the trial has been scheduled to commence on March 30. Crown prosecutor Brendan Campbell indicated that the trial is expected to last approximately ten days.

Avery has been remanded in custody, with a readiness hearing set for February 13. The case continues to develop as authorities gather further evidence and prepare for the upcoming trial.
